Do I need a separate insurance policy for protection in case a HIPAA violation lawsuit is ever filed against me? It doesn’t seem like medical malpractice would cover this.
Question: Do I need a separate insurance policy for protection in case a HIPAA violation lawsuit is ever filed against me? It doesn’t seem like medical malpractice would cover this.
Are there policies out there and is it worth it?
Answer: HIPAA insurance policies are available. Often, they couple HIPAA issues with protection around, say, using locum tenens and other administrative-related issues. Unlike malpractice coverage, it’s not mandatory (for hospital access or credentialing). As with other types of insurance, then, to decide whether you need it, you need to examine the scope of the coverage and judge potential risk and pain against the cost. Also be sure to ask your malpractice carrier what your existing coverage protects you from in these areas; there may already be something there or some easy add-on.
